"We", "Us", and "Our"- shall be used interchangeably and shall refer to Yoga and Therapy with Amber, its owners, its affiliates and/or subsidiaries, and any person or entities associated with Yoga and Therapy with Amber.

"Visitor"- is someone who merely browses this website but has not booked for our services.

​

"Guest"- is someone that has booked with us to use our services.

​

"User" or "Users" or "You"- is a collective identifier that refers to either a Visitor or Guest.

 

 “Services”- shall collectively mean our yoga and therapy sessions, workshops, events, retreats, private sessions, and all its associated activities.

 

 

LEGAL COMPLIANCE

By using our Services, you agree to comply with all applicable local and international laws, statutes, ordinances, and regulations. We reserve the right to investigate reported violations of any of our operational Terms and to take necessary action we deem appropriate, including but not limited to canceling Services we render you, reporting any suspected illicit activity to law enforcement bodies, regulators, or other third parties.

CHANGE TO THESE TERMS

We reserve the right, at our sole discretion and without prior notice, to make additions, modifications, remove, or change portions/all these Terms at any time. Users will be notified about any changes through the website. In addition, Guests will be notified through a message sent to their associated account e-mail.

Changes will automatically be effective when posted unless we state otherwise. We urge Users to review the latest version of these Terms on this page any time they visit this website or make use of our Services. Your continued use of our Services without reading these Terms and their subsequent updates any time you use our Services means your acceptance of the latest version of these Terms.

 

In cases of disputes, the version of this Terms of Service at the time we receive your dispute notice will be applicable in resolving your dispute with us.

 

These Terms of Service and our Privacy Policy shall govern should any other policies of ours conflict with any provisions of these Terms and our Privacy Policy.

 

SERVICE POLICIES

 

Your Health

It is the responsibility of the guest to inform our us about their health conditions, any injuries, and to be conscious of the capability of their body while participating in any of our services. All guests are advised to stop any ongoing activity as soon as they experience any discomfort or injury.

 

It is the responsibility of the Guest to consult a medical expert who understands yoga and fitness activities to examine their health status and confirm they are in good condition to partake in yoga classes and other physically challenging activities they decide to engage in while using our service.

Guests are to inform us of any health or mental conditions and dietary requirements before booking. We reserve the right to advise a guest to stop participating in certain activities if we notice they have a health condition or dietary requirements that will negatively affect their health.

Some of the activities of our retreats take place in terrains that are uneven, whilst we ensure all safety precautions and health measures are observed, we do not guarantee there will be no injuries and we take no responsibility for any injury caused by uneven terrain.

Women with pregnancy of 12-28 weeks old are required to provide fitness clearance letter from their health practitioner which shows they can travel and able to partake in physical activities that we provide.

Acknowledgement of risks

The Guest hereby warrant and acknowledge that participating in our services may involve unforeseeable traveling and physical exercise risks and that participating in such retreat is voluntary irrespective of the risk involved. The Guest hereby assume all risks involved knowing fully well that we may not be able to provide professional medical advice or provide needed emergency assistance. It is the responsibility of the guest to seek medical clearance from their medical practitioner before using our services if they have prior health concerns or health risks.

 

As a Guest, I am fully aware that activities such as observing silence, intensive meditation, and other associated retreat activities (e.g., pranayama, Cranio-Sacral therapy, Sound Massage, Guided Imagery) may involve intense and/or unusual psychological, spiritual, and emotional experiences of mind and body. I hereby acknowledge that my participation in these activities is voluntary and with full knowledge of all possible risks involved and I agree to accept any risk that arises as a result of my participation.

 

Guests who are on prescribed medication or have any mental illness are require to have/show a medical letter from a professional doctor/psychiatrist/psychologist/consular.

Indemnity

The Guest agree to indemnify and hold Yoga and Therapy with Amber, its teachers, its subsidiaries, affiliates, and respective officers, agents, partners, and employees, harmless from any loss, liability, demand, injury, accident, mishap, claim or legal proceedings brought or threatened, including expenses suffered or incurred arising out of Guest’s voluntary use of our services.

Payment Policy

The prices of our services are listed under the respective services. Payments are to be made in full to be considered booked. Prices do not include any form of insurance. 

 

It is the responsibility of the Guest to make provision for suitable health and travel insurance which covers your activities while using our services as well as unexpected cancellation, sickness, losses and all the usual risks. We do not provide insurance product of any sort and we will not be held accountable for a Guest’s failure to make provisions for suitable insurance that covers for medical, financial, and any other situation that requires insurance coverage.

EVENTS/ RETREATS/ PRIVATE SESSIONS CANCELLATION POLICY

Workshops/ Events 

Cancelations made from a week prior to a workshop/ event will be charged a cancelation fee of 50%. 

 

Retreats
Any cancellations up to 3 month before will be refunded -AUD$100 deposit fee
Any cancellations between 3 to 1 months before will be charged 15%
Any cancellations from 1 month - 1 week prior will be charged 50%
Any cancellations of 1 week prior will be charged 100%

 

Short (1 & 2 day) Retreats

Any cancellations up to 7 weeks/ a month before will be refunded -AUD$50 deposit fee

Any cancellations between 7 weeks/ 30day -12 days before will be charged 15%

Any cancellations from 12-4 days prior will be charged 50%

Any cancellations from 4 days prior will be charged 100%

Appointments

Cancellations or No-show on the scheduled day will be charged 50%.

 

Covid lockdown

For retreats/ therapy sessions/ events/ workshops – If Covid interferes with our services, bookings will be cancelled, we will refund full payment to our guests through the channel their payment was made. Please note, we will deduct any applicable transaction fee associated with your method of payment.

 

Our Right to Cancel Booking

Yoga and Therapy with Amber reserves the right to cancel and evict a guest without refund under any of the following circumstances:

 

• When the Guest is deemed liable to conduct and/or has conducted himself/herself in a manner that will contravene the law or act against the public order and good morals in regard to his/her participation in any of our service;

• When the Guest can be clearly detected to be carrying an infectious disease;

​

• When a Guest is deemed likely to behave in a manner that will trouble other Guests during the retreat or behaves in such a manner due to intoxication or other causes;

​

• When a Guest shows signs of severe mental disorder/illness (disclosed or undisclosed) that is beyond our control; and

 

• When a Guest do not follow the prohibited rules.

 

Guests shall always abide by our service policies, including the any accompanying guidelines. Yoga and Therapy with Amber reserves the right to bar any Guest from our service if the Guest is determined to be a threat to other Guests, and/or is abusive to our staff. The Guest shall be responsible for the charges incurred by and its actions that leads to any harm or damage to anyone or the property of Yoga and Therapy with Amber.

Late Arrivals/Early Departures:

We do not issue refunds for late arrivals or early departures from the retreat.

General Waiver

Guests hereby agree to sign a waiver with Yoga and Therapy with Amber prior to the scheduled date of the service. Guests further acknowledge that their participation in any of the activities scheduled is at their sole discretion and to the extent permitted by law, they hereby waive their rights to hold Yoga and Therapy with Amber, its agents, contractors, employees, and directors responsible for any loss, injure, damage, or death that occurs while using our services.

 

Guests must disclose any health issues or allergies they have during booking.

Eligibility

Our retreats are designed for individuals who are 18 years old or above and for minors (if guardian or parents consent to our terms and disclaimers). Anyone with disability can partake in our retreats if the retreat center is accessible to them, those who can’t take 100% care of themselves are required to have someone who can assist them (paid). People with disabilities who cannot take care of themselves nor have someone to assist them are sadly not allowed as we currently do not have provisions and expertise to accommodate them and there are areas of the retreat that may not be accessible to people with mobility issues.

Exclusions

All verbal correspondence, virtual presentation, and written information on our website is correct at the time of publication. However, the correctness of published information or availability of amenities may be affected mechanical faults, weather conditions, unforeseen circumstances, or “Acts of God” which are beyond our control.

 

 

Yoga and Therapy with Amber will not be liable for:

 

• Any circumstance beyond our control.

• Any loss, injury, or damage to a guest or their property.

• Physical, medical, or psychiatric conditions developed during or after our services.

Photo / Video Release – Use of Image

The Guest hereby confer on Yoga and Therapy with Amber the absolute irrevocable right and royalty free license to use its images, videos, photographs, and created derivative works in any media for any purpose (except pornographic, defamatory, libelous, or otherwise unlawful) which may include, among others, advertising, promotion, marketing of its business. You agree that my images and videos may be combined with other images, text and graphics, and cropped, altered or modified.

As a Guest, you agree that you have no rights to the images, and all rights to the images belong to Yoga and Therapy with Amber. You acknowledge and agree that you have no further right to additional consideration or accounting, and that you will make no further claim for any reason to Yoga and Therapy with Amber, including without limitation any and all claims for libel or invasion of privacy.

 

 

Complaints

We are confident that you will not find cause for concern while using any of our services and retreats. If you feel that a complaint is warranted, you must raise the issue directly with our director. Any retrospective complaint must be made in writing to Yoga and Therapy with Amber within 14 days of the end of your retreat.

CONTENT OWNERSHIP; USER LIMITED LICENSE

All contents provided to you through our Services are owned and licensed to Yoga and Therapy with Amber. Our contents and all associated Services are trademarked, copyrighted, and have obtained worldwide intellectual property rights. All rights are reserved. Yoga and Therapy with Amber, subject to your acceptance and abiding by these Terms grants you a limited license to use our website. You agree not to use our Services in any way that will tarnish our good public reputation or bring us any liability. We reserve the right to terminate, ban, and seek further legal actions against you if you breach any of these Terms.

 

YOUR ATTEMPT TO DISRUPT, MANIPULATE, HIJACK, HACK OR INTERFERE WITH THE SERVICES OR OPERATIONS OF Yoga and Therapy with Amber WILL BE CONSIDERED A BREACH OF OUR OPERATIONAL POLICY OR VIOLATION OF CRIMINAL AND CIVIL LAWS.

PROHIBITED USES

In addition to other prohibitions as set forth in the Terms of service, Users are prohibited from using the site, its content, and our services: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international, federal, provincial or state regulations, rules, laws, or local ordinances; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, disparage, intimidate, or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code that will or may be used in any way that will affect the functionality or operation of the Service or of any related website, other websites, or the Internet; (h) to collect or track the personal information of others; (i) to spam, phish, pharm, pretext, spider, crawl, or scrape; (j) for any obscene or immoral purpose; or (k) to interfere with or circumvent the security features of the Service or any related website, other websites, or the Internet.
